Intellectual Property Guidelines
- For the service work requested by a third party and performed by iBioFoundry staff under the iBioFoundry’s Facility Use Agreement or Service Agreement: Creation of new IP is unlikely, but if any IP is created in the performance of service work that derives from the third party’s data, information or materials, the new IP shall be owned by the third party, except that any developments of the methodologies, processes, technologies or know how of the University of Illinois shall be owned by the University of Illinois.
- Research work performed by a third party researcher with or without collaboration of a University of Illinois researcher: Inventorship shall be determined in accordance with US patent law and ownership of inventions shall reside in the employer of the Inventor, except if there is a separate research agreement executed between the parties, in which case, the terms of that agreement shall govern.
- Exchange of proprietary information: The exchange of proprietary information, data or materials may be subject to the terms of separate confidentiality agreements or material transfer agreements.
